Starting from the ius commune of the nineteenth century Marc Häuser examines the dogmatic
foundations of the debtor's duty to overcome accidental impediments to performance in the
German Civil Code (BGB) as well as the influence of the assumption of risk assessments on the
existence and scope of this duty.
