the Regulations Taking into Account the Law of Sale -«: The liability system in the case of an
inheritance sale is regulated in §§ 2382 2383 BGB which deviates from the general law of sale.
The original legitimation basis for this deviation continues to apply despite the legislative
reforms that have been enacted in the meantime. This applies in particular with regard to the
abolition of § 419 BGB. However the scope of the inheritance purchaser liability must be
modified so as not to overstretch the protective idea of the standards.
